These General Terms and Conditions apply to all of online purchases made by customers (businesses or consumers) from our online shop (“e-shop“) and supplied by Muziker,a.s. (“Muziker”). A consumer is any person, who concludes a legal transaction for purposes that can be primarily attributed neither to a trade nor a profession. A business is natural or legal person or a partnership with legal capacity which, in concluding a legal transaction, is acting in the exercise of its trade or profession.

Offer and Ordering

The product catalog in the Online Shop does not constitute a legally binding offer. It is only a non-binding online catalogue of the range of products available. Muziker does not warrant the accuracy or completeness of the information provided on the website.

By clicking “Buy“, the customer makes a legally binding commitment to purchase the goods in the shopping cart.

The seller shall bindingly accept the proposal to close the contract without undue delay, usually within two working days after placing the order, having verified the availability of the products, the validity of the prices and the delivery date of the goods required by the buyer. The binding acceptance will be made via e-mail marked as "Confirmed" or a similar, semantically identical declaration. In case a higher price is detected, the seller will ask the buyer to agree to the price change prior to confirming the order.The purchase contract is concluded only when the buyer gives his consent to the price change and when the seller subsequently confirms the order.

The automated message confirming the registration of the order by the seller, which is sent to the buyer´s e-mail address immediately after placing the order, is for informational purposes only. It is sent to the buyer in order to notify the buyer that the order has been registered and shall not be regarded as the seller´s binding acceptance of the proposal to close the contract.

Statutory Right of withdrawal

You have the right to withdraw from the contract without giving any reason within 14 days. The withdrawal period shall be 14 days since the date on which you, or the third party designated by you (other than the carrier), took possession of the goods.

Extended period for the right of withdrawal for members of the Muziker Club

A consumer who is also a member of the Muziker Club is entitled to an extended 30-day withdrawal period beyond the normal 14-day period set by law. During this extended period he may exercise his right to return the goods without giving any reason. However, this right applies only to undamaged goods in the original packaging. If the operator's inspection does not reveal any discrepancy of the condition of the returned goods against these conditions, the operator shall provide the club member with a voucher equal to the price of the goods stated on the sales document, which the club member may use exclusively for the purchase of other goods. Withdrawal from the contract during the extended period is excluded in the case of those types of goods, which are in this context specified in the relevant provisions on exclusions in these terms and conditions. The right to an extended 30-day withdrawal period is vested only in the consumer who is a member of the Muziker Club and is not a legal entity.


Statutory right of withdrawal 

The buyer is entitled to withdraw from the contract within 14 days from the date of receipt of the goods, regardless of whether he has a status of a consumer or a business entity.
The buyer who is a business entity is not entitled to withdraw from the contract if the goods have been used to any extent, if they have been damaged, unpacked or if he is unable to deliver the goods to the seller in the original packaging. In such a case, the seller will either not accept the withdrawal from the contract, or, in the event of acceptance of the withdrawal, the amount to be refunded by the seller shall be reduced by the expenses necessary to restore the goods to their original condition or by the difference between the value of new goods and the value of the returned goods. The rights of the buyer-consumer are not affected by this provision.

 

Worn, contaminated, incomplete or consumer goods 

If the withdrawal from the contract is made by a buyer who is a consumer, the goods may be used to determine their nature and characteristics; but there should be no apparent wear. It is necessary to think about the costs we will have in order to bring the goods back to their original condition. The buyer is obliged to reimburse the seller for the costs associated with the restoration of the goods and the damage caused to the goods (e.g. incomplete content, worn or contaminated goods, etc.). You will avoid being charged these fees if you bring the goods back to their original condition (cleaning, completing, proper packing, etc.).

In the case of consumer goods (e.g. strings, tubes, drumheads, cleaning agents, drumsticks, etc.), the withdrawal can only be applied if the buyer delivers the goods packed in the original, intact packaging , undamaged, unworn, unpolluted and unused.


In the event of withdrawal, you must notify us by sending a clear statement of your intention of withdraw.

Please print out the completed form and attach it to the returned goods, otherwise your shipment will not be correctly identified. 
In the case of exercising the right of withdrawal, it is considered sufficient to submit information on the exercise of the right of withdrawal before the expiry of the withdrawal period.

The customer is obliged to send the goods back to us without delay, but in any case no later than 14 days since the day when he informed us about his withdrawal from this contract.

Consequences of withdrawal

If you withdraw from this contract, we (Muziker) are obligated to refund any payments we received from you at the time of purchase, including the cost of delivery, if applicable (except for additional costs incurred by choosing a shipping method different from the most convenient, standard shipments we offer).


Refund

We will send the money for the goods no later than 14 days after receiving the withdrawal notice, but not before the returned goods, including the completed form, are returned to our department (or before you can prove that the returned goods have already been sent to us). We use the same payment method as customer during purchase to refund the payment. In the event of a refund for cash on delivery and bank transfer, we only use wire transfer to a bank account. It is not possible to return the payment by postal order or cash. You will never be charged for a refund.

In cases of accepted withdrawal from contract requests made after the 14-day period (eg. consumers who are Muziker Club members or consumers who have purchased the Extended Return option) that complies with our return policies (item is in the original packaging, item is undamaged...) we issue back a refund in the form of a voucher that can only be used to purchase other goods in Muziker.
You will never be charged for a refund.


Gifts and bonuses

If you have been given a gift or a bonus along with the goods, the gift contract for such gift loses effectiveness upon withdrawal from the contract and you are obliged to return the provided gift or bonus along with the goods.


Return shipping costs

You bear the full shipping costs of the goods, even if the goods cannot by their nature be returned by standard delivery.
It is the responsibility of a customer to arrange the return shipment back to Muziker.

The right of withdrawal does not arise in the following cases: 

  • contracts for the supply of goods which are not prefabricated and have been manufactured on the basis of a personal choice or according to customer specifications, or any goods which have been tailored to the customer’s personal requirements;
  • contracts for the supply of goods tailored to the customer and goods sold per meter (cables sold on the meter, chains sold on the meter, etc.);
  • contracts for the supply of sealed goods that are not eligible for return for hygiene or health protection related reasons (e.g. In-ear headphones, etc.);
  • contracts for the supply of audio or video recordings or computer software in a sealed package, provided that it's sealing upon delivery has been breached;
  • contracts for the supply of literature (books, magazines, sheet music, tablatures);
  • contracts for the supply of goods, that might be, due to its nature, inseparably mixed with other goods after delivery;
  • sale of goods made by the specific requirements of consumer, tailor- made goods or goods intended specifically for one consumer.

Please, try to protect the goods from damage and contamination.

If possible, send the goods back to us in the original packaging together with the completed form, complete accessories and all the parts of the packaging. If necessary, use protective transport packaging to send the goods back. If you no longer own the original packaging, please ensure sufficient protection of the goods against damage during transport by using the appropriate packaging and thus avoid our claim for compensation for damage caused by insufficient packaging. These options are not a condition for the effective exercise of the right of withdrawal.  Please note that you are responsible for the condition in which the goods arrive to us (including any damage caused during the shipment to us) and any claim for damages must be brought against the carrier individually. 

Withdrawal from the contract of the seller 

The Seller shall be entitled to withdraw from the Purchase Contract due to the sellout of the inventory, unavailability of the goods or if the manufacturer, importer or supplier of the goods, agreed upon in the Purchase contract, discontinued production or made such serious changes that prevented the seller, even with all reasonable efforts to do so, from delivering the goods to the customer within the time limit set by these Terms and Conditions or at the price specified in the online store. The seller is obliged to inform the buyer of this fact immediately and refund the deposit paid for the goods (as agreed in the purchase contract) within 14 days of notification of withdrawal from the contract. Money will be refunded via the same method used by the customer for payment or transferred directly to the bank account provided by the buyer.

Withdrawal from the contract and the gift voucher 

Goods purchased by using the Muziker Gift Card can be returned (withdrawn from the contract). The customer will not be refunded cash in full, but by withdrawing from the purchase within the specified time period, he will be entitled to a financial credit amounting to the value of the coupon, which he will be able to use during his next purchase at Muziker. If the customer pays for the goods, the price difference will be refunded in the form of money.

Cryptocurrency payments  
The buyer can also choose payment in one of the offered cryptocurrencies (eg Bitcoin) as a method of payment. If, in such a case, the buyer for any reason requests a refund of the purchase price for the goods purchased via this method, the purchase price may be refunded only in the currency indicated on the invoice for the goods thus purchased, exclusively in the amount stated on the invoice.

Retention of Title

The ownership of the goods passes to the buyer when the goods are received by the buyer at the agreed place. A buyer who does not meet the definition of a consumer gains the ownership of the goods only upon a payment of the full purchase price for the goods.

Transport Damage during Shipment

If there is another piece in stock and available to be dispatched immediately, we will ensure an exchange and transport without delay. You will hand over the defective product to the courier and, as soon as it arrives to us, a new piece will be sent to you. Muziker will cover the delivery costs.

The Shipping Insurance service covers compensation for damage to purchased goods through accelerated proceedings in the event that any of the following incidents occur:

Terms of performance of the Shipping Insurance service

The insurance of the consignment covers damage or destruction of the consignment during its transport, from the moment of loading the consignment on the means of transport specified in the contract, to the moment of unloading the transported consignment and handing it over to the consignee or other person authorized by the consignee. In the case of the personal collection of the consignment at one of the collection points of either the seller or courier, the moment of delivery is considered to be the collection of the consignment by the consignee. If the consignment is divided into individual parts for the purpose of transport, the insurance cover applies to each part of the consignment separately.

The shipping insurance service provides the customer with the advantage of accelerating the complaint process. The customer is obliged, no later than 24 hours from the receipt of goods, to report any damage or destruction of the shipment to Muziker. Information regarding damage to the goods must be supplemented with photo documentation of the damaged goods. Muziker will then organize for the collection and return transport of damaged goods via courier (costs paid by Muziker). After receiving the goods, Muziker will send the customer a replacement immediately. In the event that the product is not currently available in stock, Muziker will offer the customer alternative goods as a replacement.

The customer acknowledges that the fee paid for the insurance service in regards to shipment will not be refunded by Muziker in the event of withdrawal from the contract. Claims through Shipping insurance can only be made in connection with the goods listed on the invoice, together with the purchased shipping insurance service. The application of the service cannot be claimed for goods from other invoices, other shipments, or retroactively. The seller hereby notifies the buyer that in accordance with Art. 6 (1) (a) (b) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the “Regulation”), the seller as an information system operator, will process the buyer's personal data in the process of concluding the purchase contract without his consent as the data subject, as the buyer's personal data processing will be performed by the seller for performance from the purchase contract in which the buyer acts as one of the parties.

The advertising of products on our website constitutes an “invitation to treat”; and your order for products constitutes a contractual offer. No contract will come into force between the customer and us unless and until we accept the order in accordance with the procedure detailed below. In order to enter into a contract to purchase products from us, the customer will need to follow the steps as described below in detail: Any product the customer wishes to purchase must be placed into the shopping cart by clicking on “Add to cart“; the content of the shopping cart can be reviewed anytime by clicking on “Shopping cart“. Added products can be removed from the shopping cart using the “Delete“ button. Invoice  
After making a purchase in our e-shop, we send the customer a proof of purchase (invoice) in digital form. By agreeing to these terms and conditions, the customer also accepts that we will send the invoice in digital form. Information about the recycling fee is included in the buyer's invoice.

Final provisions

Legal agreements that arise in connection with the use of the online store and the conclusion of a contractual relationship between the seller and the buyer on the basis of these terms and conditions are governed by the laws of the Slovak Republic.
The contractual parties have agreed that in the case of resolving any disputes through the courts between the seller and the buyer, the court of the Slovak Republic has jurisdiction.
